This website is operated by Rahul DF. Throughout the site, the terms “we”, “us” and “our” refer to Rahul DF. Rahul DF offers this website (SuperTip), including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/ or using SuperTip, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”). These Terms apply to all users of the site, including without limitation Creators (account holders receiving tips), Tippers (users sending tips), browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service.

SECTION 1 - ACCOUNT REGISTRATION AND CREATOR OBLIGATIONS

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence.

• Account Accuracy: Creators are responsible for providing current, complete, and accurate information during registration. Any deviation from the provided information or submission of false details may result in the immediate termination of your account.
• KYC Compliance: Creators are solely responsible for completing all Know Your Customer (KYC) requirements mandated by our payment partners (e.g., Razorpay). Failure to clear KYC may result in an inability to receive funds. SuperTip is not responsible for funds held or rejected due to KYC non-compliance.
• Tax Responsibility: Creators are solely responsible for determining, collecting, and remitting any taxes (e.g., GST, Income Tax) applicable to the tips they receive. SuperTip does not handle tax compliance for Creators.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for using SuperTip are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 5 - PAYMENT AUTHORIZATION AND FEES

• Authorization to Manage Payments: By connecting a payment gateway to SuperTip, Creators explicitly grant SuperTip the right to facilitate payment processing on their behalf.
• Liability for Fees: Creators are liable to pay the platform fee for every transaction processed successfully.
• Payment Gateway Terms: Creators receive funds directly into their connected accounts. You are subject to the terms and pricing of the respective provider.

SECTION 6 - SERVICE DESCRIPTION AND INTEGRATIONS

SuperTip acts as a technical platform and architectural bridge for tipping.

• Scope of Service: SuperTip provides the payment processing architecture and facilitates the data flow between payment gateways and alert providers. Our responsibility is limited to processing the transaction and ensuring the payment confirmation/message data is shared with:
  1. The Creator's SuperTip Dashboard.
  2. The Creator's connected alert provider (e.g., StreamElements or StreamLabs).
• Service Rendered: The service is considered rendered in full immediately upon the transmission of this data.

SECTION 7 - STRICT PROHIBITED CONTENT POLICY (PCP)

To ensure compliance with banking regulations and Payment Gateway policies, strict content guidelines apply.

Prohibited Categories: Creators and Tippers must not use SuperTip in connection with:

• Gambling, betting, or lottery services.
• Adult content, pornography, or sexual services.
• Hate speech, violence, or harassment.
• Illegal goods, drugs, or contraband.
• Any other category prohibited by our payment partners (e.g., Razorpay Acceptable Use Policy).

• Enforcement: Deviation from this policy poses a regulatory risk. If found violating allowed content norms, we reserve the right to immediately restrict or terminate your account and withhold funds if required by law or our payment partners.

SECTION 8 - BILLING, NO REFUNDS, AND CHARGEBACKS

• Audience Education: It is the Creator's responsibility to clearly explain to their audience/tippers that tips are non-refundable and chargebacks are not possible.
• No Chargebacks: Tippers agree that tips are final. Any attempt to dispute a processed tip is a violation of these Terms.

SECTION 9 - OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties of any kind. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

SECTION 10 - THIRD-PARTY LINKS

Certain content, products, and services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.

SECTION 11 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If you send creative ideas, suggestions, or other materials, you agree that we may, at any time, without restriction, edit, copy, publish, and distribute them. We are and shall be under no obligation to maintain comments in confidence or pay compensation. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, or otherwise objectionable.

SECTION 12 - PERSONAL INFORMATION

Your submission of personal information through SuperTip is governed by our Privacy Policy.

SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to service descriptions, pricing, promotions, offers, service charges, and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel transactions if any information in the Service or on any related website is inaccurate at any time without prior notice.

SECTION 14 - INTELLECTUAL PROPERTY

• Creator License: Creators grant us a non-exclusive license to use their branding solely for operating the tipping page and generating alerts.
• Platform Ownership: SuperTip owns all rights to the website design, software, and the "SuperTip" brand.

SECTION 15 - FRAUD PREVENTION

SuperTip reserves the right to withhold payouts if we suspect fraudulent activity. We may cooperate with law enforcement to investigate suspicious transactions.

SECTION 16 - NO ENDORSEMENT

SuperTip does not endorse Creator content. Tippers waive claims against SuperTip related to Creator actions.

SECTION 17 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

SuperTip is provided "as is". We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

Third-Party Downtime: We are not responsible for downtimes or technical failures originating from:

• Payment Gateways (e.g., Razorpay).
• Streaming Alert Providers (e.g., StreamElements , StreamLabs).
• Streaming Software (e.g., OBS).

In no case shall Rahul DF, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any services procured using the service.

SECTION 18 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Rahul DF and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 19 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service.

SECTION 20 - TERMINATION

• Right to Withdraw: SuperTip reserves the right to withdraw services, suspend, or terminate accounts at any time without prior notice if we believe you have violated these Terms or pose a risk to the platform.
• Effect of Termination: The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

SECTION 21 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals.

SECTION 22 - GOVERNING LAW

These Terms of Service shall be governed by the laws of India and jurisdiction of Nagpur, Maharashtra.

SECTION 23 - CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms of Service at any time at this page. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
